The Rolling Stone reported that Allman appeared in court via video on June 25. After requesting to represent himself in his own case, which Judge Jessica A. Uzcategui denied, she adjourned the case until September 1. Allman is currently in a psychiatric hospital in New Hampshire.A statement from the judge says, “In the coroner’s report, Mr. Allman stated that he has no intention of returning to California even after being released from a New Hampshire hospital,” while also discussing whether he has jurisdiction over the case.He added, “And I understand that he could be held in New Hampshire for a year and a half, and even then he would be sent back to a New Hampshire prison or a New Hampshire treatment facility. So under all of these circumstances, it doesn’t appear to me that Mr. Allman will return to California for a long time, if at all, and I questioned the court’s authority.”On the other hand, Cher’s attorney, Justin Gold, said that Los Angeles County is the right place for the case to take place. He added that, “Allman’s claims are being made while he is in prison, and he has no power,” he said. “The only reason he’s in New Hampshire right now is because he can’t leave. And for him to say, ‘Oh, I’m not going back to California,’ to avoid the administration here, that’s all it would be. His whole life is here.” The judge has now requested that Gold submit the first statement to the court on the matter by July 16.

Back in 2023, the actor filed a petition for custody of his son at the time, believing he was unable to properly manage his finances. However, when Allman announced that he had changed and was working to get back in shape, his mother refused the request.
